In general how PIO's make a response for RTI and First appeal. Whether they called the applicant and verbally send the response or non- verbally (by sending letter). Is it necessary to provide mob no.on RTI applications?
Based on the nature and circumstances of the RTI application, the concerned officer sends a written intimation/reply to the applicant. In several cases, a personal hearing is conducted in order to decide the application/appeal. In routine matters, a formal reply is sent to the applicant.
There is no such compulsion to provide mobile numbers on the application.
As per his understanding of the RTI Application, PIO prepares Reply in writing and send to the Applicant through Post Office. PIO send reply in writing through post office because he has to maintain record of replies for proof.
In case of First Appeal, First Appellate Authority is required to send Hearing Notice to the Appellant before disposing of First Appeal. However, attending hearing is optional for the Appellant. Decision of the First Appellate Authority without providing opportunity of hearing to the Appellant is INVALID. After proper consideration of the argument made by PIO and Appellant, First Appellate Authority dsposes of First Appeal.
